A North Carolina couple has been charged in their 7-year-old son’s death after he was hit by a car while walking across the street with his brother.

The Gastonia Police Department said that on May 29 at around 6 p.m., officers responded to a traffic crash on West Hudson Boulevard. Police arrived at the scene and found that a 76-year-old woman driving a Jeep Cherokee had hit a 7-year-old boy in the road. Investigators determined that the boy was trying to cross the street outside of the crosswalk with his 10-year-old brother when he was hit.

The boy, who police did not identify, was taken to the hospital, where he died.

The boy’s parents, Jessica Ivey and Samuele Jenkins, were charged with felony involuntary manslaughter, felony child neglect and misdemeanor child neglect.

“While the Gastonia Police Department offers its deepest sympathies to the family for the heartbreaking loss of their child, the investigation revealed that the children involved were unsupervised at the time the boy stepped into traffic,” police said. “In such cases, adults must be held accountable for their responsibilities to ensure a safe environment for their children.”

The driver, who has also not been identified, was not charged.

“At this time, there is no evidence of speeding or wrongdoing on the part of the driver,” police said.

Ivey spoke to WSOC-TV and identified the boy as her son, Legend. She said her wons were walking two blocks from home to a nearby store for the first time on their own when the accident happened.

Ivey told the station that her two sons were walking the two blocks home from a shopping center for the first time on their own when the accident occurred, WSOC reported.

“It was just devastating. I’m still in shock,” she told WSOC. “It’s hard. I haven’t stopped crying. My husband hasn’t stopped crying.”

A judge set bond for the boy’s parents at $1.5 million, ABC News reported.
